31 August 2010 - High Court rules on partnership dispute in Hopton v Miller

Mark Blackett-Ord acted for the Defendant in this case, which concerned a dispute between the Claimant and the Defendant, who had run a guest house together as partners. The property which was employed as the guest house was already owned by the Defendant prior to the partnership coming into existence. The court held that the Claimant had not obtained any beneficial interest in the property owing to her involvement on improvements carried out on it, and nor was the property a partnership asset. The court determined the date of dissolution of the partnership and the final amount owing to the Claimant on dissolution. His Honour Judge Behrens' judgment can be found here.
