4 February 2011 - High Court sets aside deeds of gift of shares in Curtis v Pulbrook

The High Court has held that two attempted gifts of shares in a company failed as legal and/or beneficial title had not been effectively transferred, and because the gifts were in anycase liable to be set aside under Section 423 of the Insolvency Act 1986.

The High Court's judgment is the latest in the litigation between the Claimants and the First Defendant following the judgment of Richard Sheldon QC, sitting as a Deputy High Court Judge, of 8 April 2009.
